Waiver and Release of Liability

Cycling On Purpose LLC - Young Naturalists Winter Outings

PLEASE READ CAREFULLY BEFORE SIGNING. THIS IS A RELEASE OF LIABILITY AND WAIVER OF CERTAIN LEGAL RIGHTS.

1. Acknowledgment of Risks

I acknowledge that participating in the Young Naturalists Winter Outings, organized by Cycling On Purpose LLC, involves inherent risks, hazards, and dangers that cannot be eliminated regardless of the care taken to avoid injuries. These risks include, but are not limited to:

  • Slips, trips, and falls on snow, ice, or uneven terrain.
  • Cold weather exposure, including hypothermia and frostbite.
  • Encounters with wildlife or domestic animals.
  • Unpredictable weather conditions and natural hazards (falling branches, hidden obstacles).

I understand that these outings take place in an outdoor winter environment where emergency medical care may be delayed.

2. Assumption of Risk

I am the parent or legal guardian of the minor child(ren) participating in this program. I voluntarily choose to allow my child(ren) to participate with full knowledge that the activity may be hazardous. I voluntarily assume full responsibility for any risks of loss, property damage, or personal injury, including death, that may be sustained by my child(ren) or any loss or damage to property owned by me or my child(ren), as a result of being engaged in such an activity.

3. Release and Waiver of Liability

In consideration for my child(ren) being permitted to participate in the Young Naturalists Winter Outings, I hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE Cycling On Purpose LLC, its officers, directors, employees, volunteers, land owners, and agents (hereinafter referred to as "RELEASEES") from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by my child(ren), or to any property belonging to me or my child(ren), while participating in such activity, or while in, on or upon the premises where the activity is being conducted, REGARDLESS OF WHETHER SUCH LOSS IS CAUSED BY THE NEGLIGENCE OF THE RELEASEES, or otherwise and regardless of whether such liability arises in tort, contract, strict liability, or otherwise, to the fullest extent allowed by law.

4. Medical Consent

I hereby give consent for the organizers or volunteers to seek emergency medical treatment for my child(ren) if I cannot be reached. I agree to be responsible for all costs associated with such medical care and transportation.

5. Photo/Media Release (Optional)

(This section applies only if you checked the "Photo Permission" box on the registration form.)

I grant Cycling On Purpose LLC permission to use photographs or video recordings of my child(ren) taken during the outings for use in publications, website, and other promotional materials without compensation.

6. Agreement

I have read this Waiver and Release of Liability, understand that I have given up substantial rights by signing it, and sign it freely and voluntarily without any inducement.
